So Big Brother Tony and his mates are cracking down on the filth being peddled on the interwebthingie. I have a nasty feeling that the sites he's going to be targetting belong us dangerous perverts who like to tie up and spank pretty girlies. Thus my business is going to make me a criminal.
Anyone got any ideas which EU countries will welcome (or tolerate) us dangerous sexual terrorists?

I saw this too. Its actually not much to worry about I dont think, its more stopping the illegal stuff comming in to make it in line with what we are producing over here ourselves. Like rape and voilent sex attacks etc.

and to answer Rosie's question, the Netherlands are rather liberal on that, doubt you will find much issues there, should you incorporate there - i did look into it myself the other day, it's seems to be a rather painfree process.

Our big concern is what they mean by torture and violence. Doubt they'll understand the difference between consensual torture and violence and the real thing :(

No, as those gay men who got jailed a couple of years ago will tell you, after they had consensual torture meatings, although it was quite extreme stuff they did to each other

yes and no, i was in direct contact with a guy i consider a friend, i dunno how official he does these things, especially the part with the office renting, which is required. i'll send him the thread and we'll see if he wants to engage.
supposedly the setting up if the comapny is rather easy, you must go there personally, register the name, which will cost you some 25 EUR and requires you to have an office address in NL. i understand that even a sole trader setup can have business name rather than use the name of the sole trader person.
so that article says they wanna fight the violent internet porn, it's still fine to whack off over a print magazine then, yes?

Well registering a bizz is easy and can be done in just a few hours.
However to set up a Dutch legal entity you need a Dutch place which means renting an office.
From when me and HF did some comparing NL is a bit more expensive when it comes to office space.
The cheapest we saw over here was 175 Euros monthly and then ya got what we call a dump :D
I know there are companies providing services like this for cheap but have no info on how reliable they are,

I assume if we work from our home in The Netherlands we can use that as our business address as well?
And how easy is it to get a job in Holland when neither of us speak a word of Dutch yet?

Yep home address wil do ;)
Getting a job can be quite hard specialy if you don't speak Dutch and/or German. I would recommend moving to Amsterdam or another larger city in the west where English is more used then in the east where I live where German is the second language ;)

It's not as cheap as the States but you'll have no probs over there..

tricky one, you should speak to accountants in both countries IMO.
the UK for example reports you to your home tax office if you incorporate there and have noone with a UK residential address on the board. the argument is, if noone of those making decisions for the company is a UK resdient, it's not an actual UK company. it appears they still try to drag tax out of you as much as possible, so you might end up being taxed in both places if you are not careful.

apply being the keyword. ;)
hence my suggestion to talk to accountants (best case would be one having a clue about both countries), they should help finding the best setup for you.
you will also find that each side wants to get as much out of your biz as possible.
if you pay yourself a salary for example, you will most likely be taxed in your home country. so it might in some cases be better to sort of invoice yourself, you (home) write an invoice for incorporate you (abroad) for whatever service.
see accountants. cannot repeat it enough. i'd never dare to take it up with the tax system of a country with a language i don't speak, like NL.

Well my "clue" ends in NL obviously but here's what I know:
A Dutch legal entity should pay company taxes in the Netherlands.
However if the UK is anything like NL taxwisethey will lay their income tax on you once you take money out ofthe company to live off.
HF is right that you realy should consult an accountant at least in the UK if you remain there.
i don't promote that sort of extreme stuff, but it'll be interesting to see how this develops. i hope it doesn't get as stupid as the american 2257

The chances are your company taxes will be paid in The Netherlands and your personal ones in the UK. However, I've thankfully been out of accountancy for a while so don't know for sure :)
Of course, incorporating in the Netherlands and remaining in the UK yourself won't solve the issue of avoiding any future legislation regarding the content of your website :(

That's our biggest worry - I don't really mind who gets my tax, or even how much they get just so long as I don't get arrested LOL
We're torn at the moment between the Netherlands and Northern France. Neither sets of parents are getting any younger and I like to know I can get "home" quickly if anything happens to them. My husband thinks I'd like living in The Netherlands as the people are so cool and laid back, but then again North France is cheaper and much closer to home.

France was talking about a 60% over base rate tax for all adult business a short while ago. It didn’t go through but it gives you an idea of future intentions.
We have LTD companies in the UK and Spain and we also have an LLC in the US too. Cross border taxation is very simple now and most accountants have a specialist to help with this as it is a very common accountancy issue in todays world.
With saying that, I don’t believe that you are going to get any problems at all with your content and I would bide your time for a while to see what happens.
