nope, they are challenging it now.

when they handed in their papers, it was rejected cos MS had developed a very similar interface and patented that. MS and Apple have a number of patents each, which they allow the other to use for free or an agreed fee, Apple insits that the iPod interface is their idea though and fears MS might not play too fair on that one.

guess that will teach some how the patent laws on software can backfire in a nasty fashion.
