Hi Craig, sorry i ran out of credit. I have two phones, one (my blackberry) I can make all the calls on I want, but its too big to carry all the time.
So I use an old one. Its also on contact, but its that t-mobile where you get x amount of calls, and thats it. But as I loose it all the time, I tend to use it most so no one can make calls on it.
Anyway I gave Craig a call to tell him the situation.
OK folks this is the story:
As you know I went to Drax protest.
I set off 2am, but went to the wrong station. I got stoped and search 3 times by police unrtill one pointed out I was at the wrong station.
So I drive to Drax. Get seached.
They pull all my tools out of the car (my uncle died so I got his tools) I was told to put them back in the car.
As I did I noticed a pen knife so I put it in my pocket.
He then asked me what I had on me. So I said that knife. Turns out it locks (its a fold up fishermans knife).
I get uffed and me and the dog are sent to Selby nick. (6.30am ish).
At 12pm they interview m,e then bail me.

I have to return to York today at 6pm.
My solicior says as long as I use the knife for work, its legit (as in I open dv tapes with it - to get the wrapping off).
Police are nice to me.
One shit (150) who would not give me his name (he was small fat ugly and think) starts telling me I am wrong. I tell him the story and he says to me shut up. They phone my solicitor. They descuss it. CPS wants to charge me. My solicitor belives its borderline.
I chat with him. He says take the coution as if it goes to court its 50/50 (he is dealing with all the Drax arrests).
So I take the coution.
I said to the fat twit 'what is your degree in?'. (just to wind him up). He looked at me and said it was non of my business. So I smiled and said 'So you have not got one then'. (the other two policmen started to gigle). He then said 'right, one more word and you can spend a night in the cells'. I sdmiled at him (he was well anoyed at me). I signed some stuff.
On the way out one of the police said he was sorry fatty was so rude. I said I suspect he lives at home still with his parents and still a virgin at 40. The policmen smiled.
So there you go.
What buged me was on the bbc news website and a few papers it said that at the drax protests in the early hours there was an arrest of a person with a dangerouse weapon. So basicly I was used by the police/cps to make out that the protesters were armed up.

Good thing is the caution only lasts five years.

It was a tough call.
The way I saw it was at least I do not have a criminal record.
You see if I went to court, I would suspect that the presure would be on to convict me, for the simple reason is that the police can say that there were people with weapons at the protest.
A lot of police even suported me. But it was CPS who wanted a result.
Its polotics at the end of the day. I was a usfull puppet to them.

I have to be honest all the police at both stations (aport from 150) were realy nice.
Its just that (1) they did not want me to film it, and (2) they wanted to say they had somone with weapons.
If you have a look for any news opn the drax demonstration you will probably find a mention of my arrest with a weapon.
The police got that news out quick as it was on many news sites before I got home that day (thursday) so clearly the police used it to make the demonstators look bad.

As I say sorry JP and everubody else for posting junk as I was a bit stresed.
And I did not post the full story before as to be honest I thought they may have droped the case, and i did not want to rock rthe boat.
But i am open. I am happy to tell people that i have a caition. Its my first offence. The only other time I was in trubble was when I was 20 for running a red light (3 points).

and theres the fuckers running around this country with guns and knives with REAL intent to use to harm and never get caught! I can remember one winter night walking along my road, (its a short road, not even on a street map, comes of a main road) I was 20 yards from my front door and cos I was freshly shaved grade 1 on the head and (at the time) in my usual all black clothes, jacket,jeans,boots (guess it looked sinister!) anyway a police patrol car was slowly cruising down my road, past my flat and towards me...as they get opposite me they slowed to a crawl having a real hard look at me, i thought yeah c'mon you bastards you think im about to break in somewhere! was hoping they would get out and question me, would gone the long way round that i live just over there! lol it was just the way they look at you as a possible suspect!

As i say as soon as i was arrested it was reported to the news that I had a weapon on me to make the protesters look bad.

In other words if the cps think they have one by using me as a porn, they are wong.
On SAt I shall record a statment of the event. It will explain fully what happened.
I shall then upload it.
I will contact the dax protesters and tell them they can use ity.
Its just a shame i did not vid anything just pics.
But I shall not let this lie. I have complained to the police complaints thingy and i will make a real pain of myself by contacting the media.
I also now intend to film all protests local to me, to make sure i film police being abusive.
In otherwords I am going to be a headacke to the poliuce and cps.

Sorry to hear about your problems dvtimes.
I really think you did the right thing by taking the caution. If it would have gone to court, and they thought that the original charge looked like it may not have enough to get a conviction, they would have brought in an additional charge to make sure they did get something on you. Thats what happened to me quite a few years ago.
Just one word of caution, if you do intend to get under the skin of the coppers and the cps, just be aware of the repercusions for yourself. Once they've got it in for you they can make life pretty difficult and give you a hard time over the slightest little thing. Not trying to put you off doing what you think is right, I'm just saying be aware of what could happen.

Update:
I phoned the solicitors and told them the police lied.
I said I want the caution cancelling. They said not sure if you can but they are looking into this.
A 3" blade is legal.

Legal it might be.. but what are you going to argue it's use was at a protest meeting? You weren't going fishing.
From what I understand of the "armed with a dangerous weapon" law they can do you for holding scissors if you're carrying them in the wrong place at the wrong time with no "legitimate" use to have them on you.

Correct - But, its legal to carry a 3" blade.
But its also legit if you use it for work, which I do use them to open dv cases.
However, as things have got sexy and no one is 100% clear on the law. I best not post anymore till monday when my solisitor is looking into this.
You see saome things have croped up (as in the police have been rather naughty). So please do not respond to this thread till monday.

If you had appeared in a magistrates court you would gone not guilty, then it would have to go to a crown court. The CPS would most likely have dropped it before it got anywhere near that.
