My hosting is in america, but im sure I have to abide by some certain uk laws.
I posted on gfy about this and he said I am not allowed to upload any obscene content from within the uk.
So how does everyone else cope with this? Do you use a proxy from another country (stupid question I know) Do you go on holiday to upload( again a stupid question)
Anyway Just looking for a few pointers from the pro's
None of us here upload anything obscene :)

Hey Scotty - they're all telling the truth, we're good boys & girls here :P
But basically, the concensus is that to avoid any "imperial entanglements", you should stay within these guidelines laid down by the BBFC for R18 DVDs: http://www.bbfc.co.uk/classification/c_R18.php
The laws regarding internet porn in the UK are a little hazy, but I can't think of anyone who's been busted for producing "normal" adult material.
If you upload to anywhere from the UK, you are "publishing" from the UK. Where you host isn't relevant. Most of us host in the USA because it's cheaper, it's nothing to do with legality issues.

Good advice.
The Video Recording Act, do I have the name right?, was brought in because of the the failure of the authorities to get convictions under the "Obscene Publications Act"
But the Video Recording Act does not apply to the Internet, I think. Check with a lawyer.
Chances are if you can buy it on an R18 you are a long way from being "Obscene".
Do you have a lawyer who is familiar with the porn industry?

You are looking for a black and white answer and the simple fact there isnt one I'm afraid. Its grey. Until it gets tested in court.
Like Dave & Paul said, the general belief is as long as you stick to stuff you can buy in a licenced sex shop you will be OK.
If you go to places like Erotica in the centre of London at Olympus, that 100's of 1000's of people attend. You can see 100's of business running those types of business's and sites, no one bothers them.
Here is something That Elisha wrote about it. See the thread here http://www.beerandbollocks.com/forum/showthread.php?t=5193
The following content is now to be permitted for both heterosexual and homosexual activity.
- Aroused genitalia.
- Masturbation.
- Oral-genital contact including kissing, licking and sucking.
- Penetration by finger, penis, tongue, vibrator or dildo.
- Non-harmful fetish material.
- Group sexual activity.
- Ejaculation and semen.
The following content is not acceptable
- Any material which is in breach of the criminal law.
- Material likely to encourage an interest in abusive sexual activity (e.g. paedophilia, incest) which may include depictions involving adults role-playing as non-adults.
- The portrayal of any sexual activity, whether real or simulated, which involves lack of consent.
- The infliction of pain or physical harm, real or (in a sexual context) simulated. Some allowance may be made for mild consensual activity.
- Any sexual threats or humiliation which do not form part of a clearly consenting role-playing game.
- The use of any form of physical restraint which prevents participants from withdrawing consent, for example, ball gags.
- Penetration by any object likely to cause actual harm or associated with violence.
- Activity which is degrading or dehumanising (examples include the portrayal of bestiality, necrophilia, defecation, urolagnia).
She went on to say "One source. and this one is from the met police (internet watch foundation)..."
Criminally Obscene Content
The law on obscene publications is difficult to define in everyday terms.
As a guide it could include images featuring acts of extreme sexual activity such as bestiality, necrophilia, rape or torture.
Please note we can only deal with obscene content that is physically hosted in the UK.

Sounds like freddy again, there was someone else as well asking the exact same thing.

To my memory the Obscene Publications Act, was about the likelihood of the content "Depraving and Corrupting those it is intended to be viewed by"
I may have the wording wrong but that was my understanding of it and as someone who produced porn is far lass acceptable times in the UK I would say you have to push the envelope to get prosecuted under that law.
But ask a lawyer to be safe.
