did you just knock one up yourself? get one of the many standard versions off the net? or did you use some lawyer help with setting it up?

have you run into issues because of wording or missing parts?

Lawyer worded ours for us a couple of years ago. Before that we used a standard release we were given by the Paul Raymond people back in the 80s

I wrote my own, and it tied the mods up in knots - had plenty of legal experience in the ents/media industry before working as a webmaster. did the girls ever take more than 3 seconds to read it? no!

well, if they sign it, they are caught anyway. more less that is.

i'm pondering release forms these days cos i always thought i had a very good one, with basically all the bases covered.
now i learn that one model here took a photographer to court, she wanted her pics offline and all, despite being paid and having signed a contract. what she did was she acted like a real bimbo and convinced the judge that she didn't understand what she signed. and she won.

now what is one to do? keep it simple and risk loopholes ('i didn't think, i didn't expect, i hoped, i thought, i meant, ...') or cover everything and open another backdoor of being too complicated.

What is complictated about that?

So long as you have your cheque book in your hand when you give them the pen they will sign it quick enough and with possible 2257 problems around the corner you really need to do things properly.

just because i understand the contracts i sign, and obviously you seem to do, doesn't mean others do, and clearly they find ways to get out of them by acting innocent or clueless.

seeing the field the business is done in, i'd hazard a guess and say many a judge will be tempted to be on the side of the poor model, who has been dragged into this pit of filth.

being right is one thing, getting a right acknowledged another.

Sorry but if you have your lawyer draw up a proper *legal* contract (model release) she can give the whole courtroom a blowjob and it wouldn’t help her. This has been proven a couple of times in the UK to my knowledge and the only time it has turned out in the models favour was when someone was using an old Practical Photography cut along the dotted line type release. A contract is a contract no matter what anyone tells you or we wouldn’t bother with them at all.

No, I don't believe it did if they had a proper lawyer and if that lawyer drew up the release and they took that lawyer to court with them.

A contract is a contract. Not sure if you are aware but more cases have been won against models that have signed no release at all and still had no control of their content. We have never had a problem with our releases and I don't think that our lawyer expects any soon. :)

My model release is very clear.

All models sign it. It also states how much they were paid too.

I am suprised that judge went with the model. Unless the contract was unclear.

This is why I like to also shoot DV film, as if there was a problem, I would just play the tape to show the model clearly new what she was doing.

To be honest, I would think it would cost a model a lot of money to go to court.

My advise is if your just taking photographs, also take a mini dick player and get her to read into it confirming the shoot details.

I think that just about everyone shoots video now of the model signing the release as well as holding up his/her IDs and telling the camera the date, the type of work they are booked to do and how much they are being paid.

as i said, you are entitled to all your beliefs and opinions. doesn't make the fact go away that there is a very recent case that i had to witness, despite the seemingly bullet proof contract, set up by a lawyer.

surely your lawyer is also aware that a EU citizen, which surprisingly also counts for UK citizens, can take every case to a EU court.

hope the view is nice from the ivory tower. ;)

it wasn't unclear at all, quite the contrary, it laid out every detail. which is exactly where she started, claiming the contract was too complicated for anyone not familiar with them and that she wasn't quite aware what exactly she was signing.

what people miss is how much room for manoeuvre a judge has.

nope, as it's just been in the court of first instance. court results are not published on the web here and the case is definitely not interesting for the media. if at all i could imagine the Sun-look-alikes to pick it up and trash the photographer for ruining a young woman's life. i prolly would not have heard of this myself, if i didn't know the guy through a photographer forum.
the reaction in the forum was interesting, as many seem to have run into models suddenly wanting their pics taken down, which usually is solved in a more friendly fashion.

i doubt it will go any further either, cos he just said fuck it after consulting another 2 lawyers who both basically supported the judge's decision. which obviously doesn't help him financially.

but your contracts are fine anyway you say, so maybe it's a good idea we set up the UK Limited and have all our contracts in the name of it then. ;)

I think you will find that he was either using a fishy release, a muppet for a lawyer or he is pulling your leg. :)

yes its fine, I think we are all to grown up to pretend other boards done exist, plus GFY can on occaisions be a good source for info
