a thought i had, do people in gay weddings take there partners name as in the tradition the wife takes the husbands name?

Also when people get married (as in a standered marrage), when a wife takes the husbands name, is this a legal name?

I mean if i wanted to change my name i would have to do it legally.

so if say kelly Smith, marries Tony Green, and she opts to use Kelly Green, is that now legall, or does the marige certificate make it legall?

Actually there is no requirement legally in changing your name, it can be as simple as deciding to change your name and just changing it everywhere it's used. (As long as it's not being changed to defraud)

A deed poll, although a very handy document to have as a statement you wish to be "legally" known by a certain name, isn't actually a legal requirement to change your name.

A marriage does not legally change anyone's name. It's just down to choice on whether one or the other starts using the other spouse's name, or keeps their original name, or opts for a double-barrelled.

You can decide to call yourself Iyma Twat tomorrow and just send off for new driving license etc in that name. You don't need to do anything lawyer-wise other than change all your ID's (and bank etc) to the name (the only thing you can't change is your birth certificate - you can apply for a passport etc in your new name).

Actually deed poll isnst used much these days. Generally you do a statdec ( statutory declaration ).

You dont need a lawyer to do it you can do it yourself with a standard form. It basically says "I David Penis relinquish the name of David Penis and wont ever use it again under penalty of a knee in the nuts from the fraud office and wish to be known as Richard Penis from this day forward"

You date and sign it with your old sig and new sig, get two witnesses to sign it and job done.

In fact its worth having a lawyer do it - because its not expensive. The charges for a statdec are limited by law to about £25 and if a lawyer does it you get less flak from the bank and the passport office. Some banks are easy and will just go ahead but I had one credit card company say 'fuck off - our system doesnt allow for that so we'll just keep using your old name' thats a bit of shit for them then because legally once you statdec there is an obligation for all parties going forward to use your new name - any that dont you can simply say 'I wont pay until you do' and if they dont you dont pay and its perfectly legal - if they took you to court they'd lose.
Also the passprt office can be a bit pissy if you statdec yourself and start asking for references etc whereas with a notarised copy of the statdec its easy.
