If you set up a pay porn site on a uk based server do you need to have a licence in the same way that a sex shop that sells dvd's needs one?
Or any other similar licences for that matter?

uk trading standards don't allow the sale of R18 DVDS over the net. This is because you need to be able to see the punter at the point of sale to ascetain whether or not he's over 18

If by porn you mean HC then dont bother - legally you are asking for trouble and in all honesty I doubt any UK based host would touch HC anyway. If you are talking about softcore or solo girl / model type sites then legally you should be OK but hosting in the UK is more expensive than most other countries for no real benefit (there is a slight speed benefit if your surfers are in the UK).

basically the idea i have in mind is amateur submitted photo and video site, but could really do to know what i need to do to keep myself covered. The reason i chose uk based server was because i'm not confortable putting my home address on a 2257 page if i used an american based server.

You are going to accept photo and video uploads to your server from surfers?

I *could* be wrong here but why do you have to specifically put your home address? Why not a business address? Or that of your solicitor? Or accountant? Or even use some of the confidential mail forwarding companies?

yes

If so then believe me worrying about putting your home address on a web page is the least of your worries under 2257 - take my advice and dont do this, you are asking for trouble with a capital T!

any other suggestions that are similar then but less troublesome?

yes

Then I would advise that you have a very good (and very expensive) lawyer on standby.

The reason they want your address is so they can come and look at all the records you have for every single HC image on your site to prove everyone is over 18, which is a nightmare with user-submitted sites.

The UK and the US are not the only countries to offer hosting. I use Servage (http://www.servage.net/?coupon=cust10752) which is based in Denmark and allows adult content, but like with anything you need to shop around to find out what does the best job for you and your business...

I remember having UK hosting in the mid 90s and paying £90 a week on top of the extortionate hosting bill just for FTP access. Those were the days. :)

Yes you buy content and pass it off as amateur contributions so that you have all the documentation you need should the law come knocking.

Or produce your own content for the same reasons.

Still well clear of contributions - you can't verify and you have no documentaion. You could of course insist that all contributors supply appropriate documentation with their contributions - ie model releases and photos of them holding photo ID next to their face to prove they are who they say they are and are of age for everyone participating in the photos/videos. But that would prolly shut off all but the odd contribution anyway.
