Also

i can't believe anyone would seriously wonder whether they can legally use material shot of people without their knowledge.

Well it depends what it is I suppose, when you see a news item and there is a crowd do you think they get the permission of all those in the crowd.

I know that's a bit different to filming someone having a bunk up, but usually if you are in a public place then there is no problem. But then again you would get nicked filming upskirt in a public place, but that's more to do with the personal space being invaded. You could takes pics and vids all day of people in a high street and post that material anywhere.

ALthough saying that you probably couldn't take pics of people in public and say they are a nonce or a murderer if it wasn't true, oh bollocks, I'll shut up now, well after the next line :)

So next time go and have a portion in the high street :Penis

apples and oranges. there is a difference between having your picture taken in a public place, when you engage in street life or having a fuck in your private place.

a one night stand with some half stranger doesn't count as involving in a public event either. :p

matter of factly, in many a place you could find yourself confronted with the police, if you take pics of houses without the owner's consent.

So inside your garden up against the fence is not ok, but outside up against the same fence is ok? Im not disagreeing but interested in your opinion. At the end of the day, especially in this country. Privacy laws are dependant on private prosecutions not often the law.

i'd think having a fuck on your front lawn where others can watch you might qualify as public nuisance and as such might get you little luck if you try and get the photographer slapped.

if you do it in a secluded area like inside your house, or even in a remote corner of your garden, where noone could see you unless they get onto your property, it's clearly invading your privacy to have yourself taped or photographed without your consent.

There was a specific law passed a little while back to cover CCTV tapes (video tape that is) being sold to television companies and websites which in effect makes anything recorded without the participants knowledge or consent for financial gain very illegal. This law was passed in response to the police actually selling CCTV tapes to television companies and the law that was put together in haste was pretty far reaching.

interesting point BTW, the police selling CCTV tapes. who actually owns the cameras and therefor the tapes? i sort of assumed they were council owned.

These particular tapes were police owned and their point was that they were duty bound to get a return for the second hand tapes if possible. I think that it was one of these tapes that showed a young couple just out of a night club shagging in a lift so the government acted straight away and the law was made very broad on purpose so as to cover all recording formats.

If you manage to leave the faces out of it or dark enough so noone can tell who it is, I bet you will not find anyone wanting to adimt to being the ones caught screwing around in public. You should be safe. ;)
