View Full Version : anyone take their bank to small claims?
I was going to claim back over a grand in charges but I got in a bit late and they told me I had to wait for the outcome of a courtcase
has this been done?
anyone get in early and get their money?
I was always in credit overall at the bank but my money was usualy in the $ account so when I so I'd get caught out by direct debits on my personal account and get charged £35 a time.
When you have to go into the bank to get the $ balance or do a transfer because the phones are engaged most of the time this can happen.
Yes someone has...and the bank won the test case:fighting0097:

they shouldnt pay anything back, if people can not manage their accounts they should acept the fees.
Its like a lot of things these days, the floods, the government are expected to bail out those with no inssurance, Northern Rock again the government promising people they will not loose money.
The up shot of it al is that the rest of us who manage our finances and pay things on time will end up having to pay for banking. If you can't pay a DD or remeber to pay it on time then too right you should be fined.
As with everything the people who don't fuck up will end up paying for those who do......

You must put a letter in stating that you belive that you are owed refunds on bankcharges, and you request that this is backdated from today.
There is currently a few test cases so banks are not doing anything, but.... they must backdate you for up to 5 years (I think its 5). While the case is going on they will not do anything, but you still must register as they will at some point have to refund your money (from the date of the letter), so even if it takes 10 years to sort out, you have registered it today and as such it will be backdated from today.

Its the law.
Banks are not alowed (by law) to make a profit of the charges.
Ie, if they charge you £30 for going overdrawn, the real cost to the bank in admin is sothing like £3. As such banks are breaking the law.
I got money back, this was the banks fault. I paid in cash, but the next day I had DD. For some reason the bank had not updated its computers and the first DD bounced, so did the next. In fact I had 5 DD that day bouncing. Some were even just £3, yet the bank charged me £30 each. In 5 seonds I had £150 of costs.
I phoned up and they said sorry and refunded the money. It also meant I had to contact the firms with DD to set stuff up again.
I told the bank manager that its ilogical to do such charges as if people end up with them, they start to have more and more and end up in a situation where unless they change banks cannot even pay bills.
From what I have seen its an easy method in the short term for banks to make a quick profit, but long term will loose them customers.
In deed those with a business are more likly to suffer from bank charges.
For instance this week many businesses will have checks in the post to them, and untill the postal strike is over unable to receave them and pay them into there account. Yet they will still have bills to pay. This may push them into huge bank charges. This can be enough to make a business go bust.

By the way Norther Rock got into a mess due to USA banks.
In the USA banks have been lending cas to the poor, who have been buying low grade homes.
In the USA you must remeber that unlike the uk where most homes are brick, many have pre fab houses, or even caravans. Many of these were only designed for a short life. So what the result has been is people unable to re-pay there payments, and the banks being left with property they cannot sell (because its worthless).

she still need to write to the bank and date the letter.
no point doing it after this case as if the banks are clever they will mess about for years, untill even if they loose people will have left it too late to claim (they only need to backdate 5 years or somthing).
So although nothing will be done, she needs to send in a letter so she has recorded the situation with the bank.

What pisses me of is when they say use internet banking as that's up to date with your account status blah de fucking blah, is it fuck!!
I go in one hour of the day and it says something, go in another and it's minus the amount of before and go in later on and it's up again - I don't even leave the house and it changes all the time.
It's NOT really accurate at all. You can wake up and say have a 0.00 balance in the account, go for a fucking nap wake up with - 100 and go for a pee and come back to 200.00 and it goes the other way around too, it's fucking ridiculous, how are you supposed to use the internet banking when it changes its fucking mind every two bloody seconds...

Use Nationwide - their internet banking is in real time and I have never had an issues with them. LLoyds on the other hand the online stuff I find very very basic.

If it doubles for a kip, and doubles for a piss - Drink 50 gallons of water a day -You'll be rich in no time.

I would send a letter to the bank saying that you wish to record on record that today (todays date) you wish to have a refund.
Include as much info as you can, and inc a photocopy of evidence.
But do not just send it to your bank but make a few copies (CC) and send them to the main bank address and the banks complaint department and a few other branches, that way they cannot say they did not get the letter.
I find I get a better response if when I write to a firm I also send a copy of the letter to there main office as that way they cannot just ignore it.
At the moment with the postal strike its a pain, but its well worth doing.
My mates and family think I am like some old man writting my letters, but they have found it to there benafit.
One example was my mate moved into a flat and I found there was a small water leak. The builder said he would fix it.
I wrote to the firm who owned the flat to inform them (it was housing assousiation).
A few months later they were accused of doing the damage, and were sent a bill. But I simply contacted them and said if they look they will have on record my letter. They wrote back to my mate and said sorry.
Somtimes being old fashioned helps.
done all that, they are not budging. they are sitting it out and awaiting the outcome of the court cases

thats fine, as long as you have put the letter in.
I would also write again and inform them that you will expext interest to also be paid on the finall payment too.
